Partner Of A New Zealnder or Of A New Zealand Resident Visa Holder

This type of visa is for partners of New Zealanders or New Zealand Residence visa holder that want to join their New Zealand partner in New Zealand.

Eligibility:

In order to be eligible for this visa, the applicant needs to prove that he/she is living in a genuine and stable relationship with his/her New Zealand partner and that the couple is living together.

In case of periods of separations, it will be necessary that the applicants provide evidence of valid reasons for the separation and of the efforts made to reunite during the time spent apart.

Duration of a Partner-of-a-New Zealander temporary visa 

It is important to keep in mind that the main purpose of temporary visas issued by Immigration New Zealand for partners of New Zealanders is ultimately to provide a pathway to residence under Partnership Category. For this reason, these types of visa are normally issued for a period not exceeding 24 months.

Specifically, if the couple has been living together in a genuine and stable relationship for less than 12 months, the first visa issued will not exceed 12 months. This visa can be renewed for up to 12 months if the partners wish to spend more time in New Zealand or if during the validity of the first visa an application for a Partner of a New Zealander residence visa is made.

If, at the time of application, the couple has been living together in a genuine and stable relationship for 12 months or more, the partnership visa will most likely be issued for a period of up to 24 months.

In any case, the maximum stay allowed by these temporary visa instructions is 24 months, the rationale behind this limit of duration being that this visa is supposed to be a pathway to residence.

Applicants that have not applied for a Partnership residence visa during the validity of their temporary visa, but that wish to apply for a further work or visitor visa after the maximum stay of 24 months has been reached, might do so only when compelling justifying reasons for a request for exception to instructions can be provided.

Partner Of A Work Visa Holder (Work-Open Or Visitor Visa)

This type of visa is for partners of work visa holders that want to join their partners in New Zealand. 

Eligibility:

In order to be eligible for this visa, the applicant needs to prove that he/she is living in a genuine and stable relationship with the partner holding a work visa and that the couple is living together.

In case of periods of separations, it will be necessary that the applicants provide evidence of valid reasons for the separation and of the efforts made to reunite during the time spent apart.

It will also be necessary to prove that the work visa holder that is supporting the application is the holder of a 6-months visa (or of longer duration).

An applicant will be considered not eligible for this type of visa if the supporting NZ work visa holder partner:

  • Is the holder of an Essential Skills work visa assessed as low skilled
  • Is the holder of a Foreign crew of fishing vessels work visa
  • Is the holder of a Working Holiday Scheme work visa
  • Is the holder of a Recognised Seasonal Employer work visa
  • Is the holder of a Supplementary Seasonal Employer work visa
  • Is the holder of a Silver Fern Job Search Instructions work visa
  • Is the holder of a Skilled Migrant Category Job Search Instructions work visa

Duration of a Partner-of-a-Work Visa Holder temporary visa 

Partner of a worker work visas will be granted for the same period as the work visa held by the applicant’s partner.

Partner Of A Student Visa Holder (Work-Open Or Visitor Visa)

Eligibility:

In order to be eligible for this visa, the applicant needs to prove that he/she is living in a genuine and stable relationship with the partner holding a student visa to study a Level 7 or 8 qualification in an area specified on the long Term Shortage List or a level 9 or 10 qualification and that the couple is living together.

In case of periods of separations, it will be necessary that the applicants provide evidence of valid reasons for the separation and of the efforts made to reunite during the time spent apart.

Duration of a Partner-of-a-Student Visa Holder temporary visa 

Partner of a student work visas will be granted for the same period as the student visa held by the applicant’s partner.

Culturally Arranged Marriage Visitor Visa

Eligibility:

People intending to marry New Zealand citizens or residence class visa holders in New Zealand on the basis of a previously cultural arrangement, if the culture follows a culturally identified tradition, the marriage is scheduled within 3 months from arrival and there is no legal impediment to the marriage.

Duration of a Culturally Arranged Marriage Visitor visa 

Culturally arranged marriage visitor visas will be issued for a maximum period of 3 months.

Visitor Visa For The Lawful Purpose Of Mariage

Eligibility:

People intending to visit New Zealand to marry their New Zealand based partner when the marriage has not been arranged. This type of visa falls under the general visitor visa instruction.

Duration of a Visitor visa for the lawful purpose of marriage 

This visa is normally issued for a period not exceeding three months.
